Are private funds regulated?

Private funds fall under the regulatory purview of the Securities and Exchange Commission (SEC). There are certain exemptions to registration available for funds that meet and maintain the related requirements. The SEC has strict requirements regarding investor qualification, e.g., “qualified purchasers,” “accredited investors,” etc. Furthermore, there are various other regulations that provide guidance on the methodologies that fund managers should employ as well as certain reporting requirements.
